Promotion name

Promoter
The “Promoter” is Tasmanian Bakeries (ABN 57 009 479 958) of
69 Patrick St, Hobart TAS 7000.
Promotion Type
Game of chance.
Promotion Period
The “Promotion” will commence on 26/05/2025 and close at
12:00PM AEST on 05/06/2025 (“Promotion Period”).
Entry Restrictions
This Promotion is only open to residents of New South Wales
who are aged 18 or over. The Promoter is responsible for determining
whether a person is an eligible entrant in its absolute discretion. The
Promoter may require entrants to provide reasonable proof that they meet the
requirements for entry in the Promotion.
How to enter
To be eligible to enter and be eligible to win, entrants
must, during the Promotion Period, like
the competition post on Instagram found here (“Competition Post”), follow @Nationalpies on
Instagram, and comment on the Competition Post tagging another Instagram user.
Number of Entries permitted
Eligible Entrants may enter as many times as they like.
Prize details
The one winner will receive the following prize (“Prize”):
Return economy airfares for two people from Sydney Airport (SYD)
to Hobart Airport (HBA) on an airline of the Promoter’s choice. One night
accommodation in Hobart at Crowne Plaza Hobart (110 Liverpool St, Hobart TAS
7000). A variety of National Pies provided for lunch, depending on
availability.
The total value of the Prize is up to AUS$1,000.
Additional Prize terms
If any Prize (or part of any Prize) is unavailable, the
Promoter, at its discretion, reserves the right to substitute the Prize (or
that part of the Prize) with a replacement Prize of an equal or greater value
as set out in clause 15 below.
The Promoter or its agencies will make all reservations in
relation to the Prize, subject to booking and flight availability. Prize travel
dates and times are subject to availability at all times. Restrictions and
block-out periods may apply including Christmas and New Year. The winner may
request that the Promoter make the Prize reservation on certain dates, however
such reservations are ultimately at the Promoter’s sole discretion. The Prize
includes prepaid airfare taxes and standard checked luggage surcharges. If for
any reason the winner does not, once the Prize has been booked, take the Prize
at the scheduled times, then the Prize will be treated as forfeited by the
winner. Once reservations have been booked, no changes may be made. The winning
entrant and his or her travelling companion must travel on the same flight, at
the same time and are responsible for their own transportation to and from
Sydney Airport and to and from Hobart Airport. The Promoter may book flights
with any airline in its absolute discretion. Qantas Frequent flyer points or
equivalent cannot be accrued on the Prize.
All costs associated with the travel Prize which are not
expressly stated to be included in the Prize details, such as incidental hotel
charges (such as mini bar, movies, telephone calls, food or beverages),
transfers, meals, taxes, insurance, other travel or accommodation, luggage
costs and all other ancillary costs, are the responsibility of the winner. The
winner and their travelling companion are responsible for ensuring they have
all necessary travel insurance and documents required to travel (including any IDs,
passports and visas). The winner releases the Promoter from any responsibility
for, or liability in respect of, the cancellation, delay or rescheduling of any
part of the travel Prize and any costs incurred by the winner or their
travelling companion as a result (including accommodation costs). The winner is
responsible for ensuring that they and their travelling companion are fit to
travel before taking the Prize. A credit card may be required by the hotel from
the winning entrant at check-in to the hotel for incidental charges during the
winning entrant’s (and his or her companion’s) stay. The Promoter is not
responsible for, or liable in respect of, any damage to their hotel room caused
or contributed by the winning entrant or his or her companion.
By entering this competition, and by collecting the Prize,
the winner acknowledges and accepts that driving, travel and any other
activities associated with the Prize, are inherently dangerous and may result
in death, injury, incapacity, damage to property or other losses.
Prize Draw
- A
random electronic Prize Draw process will take place by a representative
of the Promoter commencing at 2:00PM AEDT on 05/06/2025
- The
Promoter may draw additional reserve entries and record them in order in
case an invalid entry or ineligible entrant is drawn.
- The
first valid entry randomly drawn from all valid entries received up to the
time of the relevant draw will win the Prize.
Notification
Prize winner will be notified by direct message on Instagram
within 2 business days of the applicable draw and the winner’s names will be
published on the @Nationalpies Instagram account.
Unclaimed Prize
If the Prize has not been accepted or claimed by the winner by
9:00AM AEDT on 12/06/25, after making all reasonable attempts, the Promoter cannot
contact the winner (or the winner does not contact the Promoter) by the prize
claim date above, the Prize will be treated as forfeited by the winner and any
relevant entry/ies will be discarded and the Promoter will conduct another
Prize Draw to re-award the Prize.
If the Promoter is unable to get in contact with a
subsequent winner within 2 business days, after making all reasonable efforts,
the Promoter may similarly treat the Prize as forfeited by the subsequent
winner, discard any relevant entries and conduct another Prize Draw to re-award
the relevant Prize.
Further Terms and Conditions
- Information
on how to enter the Promotion form part of these Terms and
Conditions. Participation in this competition is deemed acceptance
of these Terms and Conditions.
- All
entrants acknowledge that the Promoter can rely on these Terms and
Conditions even if the Promoter only learns of a person’s ineligibility
after the Promoter has awarded a Prize to the ineligible person. Return of
the Prize or payment of its equivalent value to the Promoter may be
required by the Promoter if this occurs.
- Each
entrant is responsible for ensuring his or her familiarity with these
Terms and Conditions at the time of participation. The Promoter’s decision
not to enforce a specific restriction (whether communicated to an entrant
or not) does not constitute a waiver of that restriction or of these Terms
and Conditions generally.
- Incomplete
and indecipherable entries and any entry which has incorrectly entered
personal information or contact details shall be deemed an invalid
entry. No responsibility or liability is accepted by the Promoter
for late, lost, misdirected, ineligible or illegible/inaudible entries.
- The
Promoter may, in its sole discretion, declare any or all entries made by
an entrant invalid, and/or prohibit further participation by an entrant in
this Promotion or a Prize event/activity if the entrant:
- disrupts,
annoys, abuses, threatens, harasses or attempts to do any of these things
to the Promoter, another entrant or potential entrant of, or anyone else
associated with, this Promotion.
- submits
an entry that is not in accordance with these Terms and Conditions or who
tampers with the entry process; or
- engages
in conduct in relation to this Promotion, which is misleading, deceptive,
fraudulent or damaging to the Promoter’s goodwill or
reputation.
- If
this Promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in
its sole discretion, to the fullest extent permitted by law to modify,
suspend, terminate or cancel the Promotion, as appropriate.
- Entries
must be received by the Promoter in accordance with the terms set out
under the section titled ‘How to enter” and will be deemed to have been
received at the time of receipt by the Promoter.
- Any
costs associated with accessing the Promotion post are the entrant’s
responsibility and are dependent on the internet service provider used.
Entrants must submit their entries and/or claims manually using an
internet service.
- Total
Prize pool value is up to $1,000 AUD.
- The
entrant releases the Promoter from any responsibility or liability for any
problems or technical malfunction of any telephone network or lines,
computer online systems, communication network, computer equipment,
software, technical problems or traffic congestion on the Internet or at
any website, or any combination thereof, including any error, omission,
alteration, tampering, deletion, theft, destruction, transmission
interruption, communications failure or otherwise, injury or damage to
entries or to participants’ or any other person’s computer related to or
resulting from participation in or down-loading any materials in this
Promotion. If the Promotion is not capable of being conducted due to
circumstances beyond the Promoter’s control, including due to any
technical or communications problems, the Promoter reserves the right to
amend, suspend or cancel the competition subject to approval from any
relevant authority (if any).
- Errors
and omissions by an entrant may be accepted at the Promoter’s discretion.
Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights. If there is a dispute as to the
identity of an entrant, the Promoter reserves the right, in its sole
discretion, to determine the identity of the entrant.
- As a
condition of claiming the Prize, the winner may be required to, and ensure
that his or her travelling companion is required to, at the Promoter’s sole
discretion, sign any legal documentation as and in the form required by
the Promoter and/or Prize suppliers in their absolute discretion,
including but not limited to a legal release and indemnity
form.
- The
Promoter may communicate or advertise this Promotion using Facebook and/or
Instagram or another social media platform. However, the Promotion is in
no way sponsored, endorsed or administered by, or associated with,
Facebook, Instagram or any other social media platform. Entrants are
providing their information to the Promoter and not to Facebook or
Instagram. Each entrant completely releases Facebook and Instagram from
any and all liability in connection with this Promotion.
- The Prize
is not transferable or exchangeable and cannot be taken as cash. If a Prize,
or an element of a Prize, is unavailable for any reason, the Promoter
reserves the right to substitute another Prize of equal or greater value
for that Prize, or an element of it, subject to the approval of any
relevant authority (if any). The Promoter and its representatives will not
be liable for any damage to or delay in transit of Prizes.
- The
use of any automated entry software or any other mechanical or electronic
means that allows an entrant to automatically enter the Promotion
repeatedly is prohibited and will render entries submitted using such
means as invalid. The Promoter may, in its sole discretion,
reasonably determine if any entries have been made using such means.
- Under
no circumstances will either party be liable to the other party for any
indirect or consequential loss or damage (including any loss of
opportunity).
- Except
for any liability that cannot be excluded by applicable law (in which case
that liability is limited to the maximum allowed by applicable law), the
Promoter (including its officers, employees and agents) excludes all
liability for:
- any personal injury, illness or death
which is suffered or sustained; or
- any loss or damage, arising in any way
out of the Promotion, including, but not limited to, where arising out of
the following:
- any
technical difficulties or equipment malfunction (whether or not under the
Promoter’s control);
- any
theft, unauthorised access or third party interference;
- any
entry or Prize claim that is late, lost, altered, damaged or misdirected
(whether or not after their receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter;
- any
variation in Prize value to that stated in these Terms and Conditions;
- any
tax liability incurred by a winner, entrant or travelling companion; or
- use
or enjoyment of the Prize.
- Nothing
in these conditions restricts, excludes or modifies or purports to
restrict, exclude or modify any statutory consumer rights under any
applicable law including the Competition and Consumer Act 2010
(Cth) or similar consumer protection laws in the States and Territories of
Australia (“Non-Excludable Guarantees”).
- Entrants
irrevocably consent to the Promoter using their name in the event they are
a winner in any media for an unlimited period without remuneration for the
purpose of promoting this competition (including any outcome), and
promoting any products manufactured, distributed and/or supplied by the
Promoter.
- The
Promoter collects your personal information in order to conduct the
Promotion and may, for this purpose, disclose such information to third
parties required for the provision of the Prizes. Entry is conditional on
providing this information so that the Promoter may identify entrants,
winners and travel companions. The Promoter may disclose the
information for those purposes to its related bodies corporate and
contractors. If entrants do not provide the information requested they
will not be able to enter the Promotion. Any personal information
collected in accordance with the Promotion will be handled in accordance
with the Promoter’s Privacy Policy here. This
Privacy Policy contains information on how:
- the
Promoter collects, stores, uses and discloses your personal information;
- you
may access and seek correction of your personal information held by the
Promoter; and
- you
can make a complaint for a breach in the Privacy Act 1988 (Cth)
and how the Promoter will handle such a complaint.
- Any
attempt to deliberately undermine the legitimate operation of this
Promotion may be a violation of criminal and civil laws and should such an
attempt be made, whether successful or not, the Promoter reserves the
right to refer the matter to law enforcement authorities and/or to seek
damages or such other civil remedies as the Promoter may determine from
time to time to the fullest extent permitted by law.
- The
Promoter is bound by the Australian Privacy Principles contained in
the Privacy Act 1988 (Cth). The Promoter will not disclose
personal information to any recipient outside of Australia.
